Este libro es una obra del jurista, criminalista, filósofo, economista y hombre de letras italiano Cesare Beccaria, perteneciente al movimiento de la Ilustración. En este ensayo, Beccaria cuestiona la concepción del derecho penal y establece las bases y límites del derecho a castigar, recomendando que la pena sea proporcional al delito. Además, denuncia la crueldad religiosa y propone separar el derecho penal de la Iglesia. El texto de Beccaria provocó un gran impacto intelectual y sentó las bases de la Declaración de los Derechos del Hombre y del Ciudadano de 1789.
